On September 27, 2024, the Department of Justice and the City of New Orleans filed a CNO-DOJ Joint Motion requesting that Judge Morgan permit the City and the NOPD to enter the “Sustainment Period” of compliance, as provided for in Consent Decree paragraph 491. That motion was accompanied by a proposed NOPD Consent Decree Compliance Sustainment Plan which addresses specific NOPD Consent Decree requirements that require additional effort to achieve compliance, additional time for the Federal Monitor to review, or both. That same day, the Court’s Notice to the Public was issued that explained the process the Court will follow in evaluating the joint motion. Ultimately, the Court will determine whether to grant the Parties’ motion to begin the Sustainment Period and under what conditions. That Notice provides that over the next 45 days, the Federal Monitor will hold a series of virtual and/or in-person meetings to hear community reactions and answer community questions. That Notice also states, “The Monitor will inform the Court of all issues raised in the course of those meetings.” On November 8, 2024, the Court’s Second Notice to the Public regarding motion to enter Sustainment Period was issued, and extends the period for public comment to aid its evaluation of the Parties’ September 27th motion. For more information, see the NOPD Consent Decree Monitor website: www.consentdecreemonitor.com. The public is encouraged to submit written comments to the Court before November 8, 2024. via email to: clerk@laed.uscourts.gov or by mail, addressed to: Clerk of Court, U.S. District Court, EDLA, 500 Poydras St., Room C-151, New Orleans, LA 70130.
